new regulations regarding remote work came into force.
More and more people choose this way of working, but until now this issue has not been regulated in the Labor Code. Check what has changed!
Remote work means performing work duties in a place indicated by the employee. It may concern full-time work or part of it - hybrid work. The employee himself determines the place from which he will work, but the employer must consent to this.

The new regulations provide for several possibilities for arranging remote work between the employer and the employee.
At the stage of concluding the contract - the place of work will be entered in the contract
- At the request of the employer, who may issue such an order in the event of:
o states of emergency and epidemic (up to 3 months after their lifting);
ow as a result of force majeure, when it is unable to provide employees with safe and hygienic working conditions. In this case, the employer must obtain a statement from the employee that it has the local and technical conditions to perform work at home
- At the employee's request - the employee may apply for remote work, but the employer may not consent to this. However, the Act provides for certain exceptions. Remote work cannot be refused, including:
about parents raising children up to 4 years of age;
about parents of children with disabilities and requiring special care;
about pregnant women;
about people who care for a disabled family member (or someone living in a common household).
EXCEPTION
In relation to the above groups, the employer may not consent to remote work. But only if it is not possible due to the type or organization of the work performed.
Occasional remote work - the act also provides for so-called incidental remote work - up to 24 days in a given calendar year. An employee can apply for it. The regulations introduce new obligations for the employer:

cover the costs associated with the installation, servicing and operation of these tools;
provide training and technical assistance related to work performance;
- reimburse electricity and internet costs;
cover other costs directly related to remote work;
If the employee uses his/her own equipment (computer, telephone, etc.), the employer pays a cash equivalent.
Employer rights:

can check,
whether the employee actually works – at the agreed place and hours of work;
