Not every entrepreneur has to be an active VAT payer, i.e. a VAT payer.

If your company's annual turnover exceeds PLN 200,000, the entrepreneur is required to register as a VAT payer. It is also worth being a VAT payer if your contractors are other VAT payers and if you make many investments and company purchases. Then you can apply for VAT refunds.
How to register?
Please note that VAT payers register for VAT purposes before making their first taxable transaction.
This means you must register before:
- making the first delivery of goods to its contractors
- performance of the service
- before the day on which you lose the right to exemption, i.e. after exceeding the limit of PLN 200,000 of net sales value during the tax year
Where to register?
It all depends on the form of your business and so if:
VAT
- you run a company as a legal person (e.g. a limited liability company) or an organizational unit without legal personality (e.g. an association), submit a notification to the tax office competent for the registered office of your entity;
- you run a sole proprietorship – submit a notification to the tax office competent for your place of residence;
VAT
- you do not have a registered office in Poland, but you have a permanent place of business here - submit a notification to the tax office competent for the place of business;
- you do not have a registered office or permanent place of business in Poland – submit an application only to the Second Tax Office Warsaw-Śródmieście.
How to register?
You can submit the application in person at the office, send it by post or submit it electronically as an attachment to the application for entry or change of entry in CEIDG or via the Tax Portal. You can appoint a proxy for this purpose.
